PARTICIPANT AGREEMENT, RELEASE, ASSUMPTION OF RISK AND RENTAL AGREEMENT

In consideration of the services of Bhagwati Hospitality LLC., D/B/A ” USA INN” their agents, owners, officers, volunteers, participants, employees, and all other persons or entities acting in any capacity on their behalf (hereinafter collectively referred to as “USAINN”), I hereby agree to release, indemnify, and discharge USAINN, on behalf of myself, my spouse, my children, my parents, my heirs, assigns, personal representative and estate as follows:

• I acknowledge that my participation in electric scooter riding activities entails known and unanticipated risks that could result in physical or emotional injury, paralysis, death, or damage to myself, to property, or to third parties. I understand that such risks simply cannot be eliminated without jeopardizing the essential qualities of the activity.The risks include, among other things: accidents involving other scooters or vehicles; collision with fixed or movable objects; injuries or accidents involving contact with the vehicle; falls from the vehicle; the negligence of other operators of motor vehicles or myself; musculoskeletal injuries including head, neck, and back injuries; exhaustion; exposure to the elements of the outdoors and natural surroundings which could cause hypothermia, hyperthermia (heat related illnesses), heat exhaustion, sunburn, dehydration; the condition of roads, terrain, or highways and accidents connected with their use; exposure to potentially dangerous wild animals, insect bites, and hazardous plant life; equipment failure; improper lifting or carrying; my own physical condition, and the physical exertion associated with this activity.
  Furthermore, USAINN employees have difficult jobs to perform. They seek safety, but they are not infallible. They might be unaware of a participant’s fitness or abilities. They might misjudge the weather or other environmental conditions. They may give incomplete warnings or instructions, and the equipment being used might malfunction.
• I expressly agree and promise to accept and assume all of the risks existing in this activity. My participation in this activity is purely voluntary, and I elect to participate in spite of the risks.
• I hereby voluntarily release, forever discharge, and agree to indemnify and hold harmless USAINN from any and all claims, demands, or causes of action, which are in any way connected with my participation in this activity or my use of JESS’s equipment or facilities, including any such claims which allege negligent acts or omissions of USAINN.
• Should USAINN or anyone acting on their behalf, be required to incur attorney’s fees and costs to enforce this agreement, I agree to indemnify and hold them harmless for all such fees and costs.
• I certify that I have adequate insurance to cover any injury or damage I may cause or suffer while participating, or else I agree to bear the costs of such injury or damage myself. I further certify that I am willing to assume the risk of any medical or physical condition I may have.
• I agree to properly use and care for all rented equipment while it is in my possession and am aware that deviation from proper use or care may greatly increase the likelihood of accident or injury. I agree to properly secure/lock all borrowed equipment in legal locations when not in my possession. I agree not to use the Equipment in conditions of reduced visibility (including, but not limited to, darkness).
• I agree not to lend the scooter to others while it is in my possession, and that if I were to do so, and that if they were to suffer a loss as a consequence, that that is my responsibility alone.
• I understand and agree that should the scooter be lost or stolen while it is in my possession, USAINN will automatically charge my debit/credit card used at the point of sale for the retail value (ranging between $1099.99-$1399.99) of the scooter. I understand and agree that USAINN will not notify me prior to this transaction. The transaction will take place no sooner than 24 hours after the scooter is reported missing. I understand and agree that should my rented helmet be lost or stolen while it is in my possession, USAINN will automatically charge my debit/credit card used at the point of sale for an amount of $40. I understand and agree that should the key fob be lost or stolen while it is in my possession, USAINN will automatically charge my debit/credit card used at the point of sale for an amount of $100. I understand and agree that should I not return the scooter at the agreed date/time per this Agreement, USAINN will automatically charge my debit/credit card used at the point of sale for a minimum of $25 for the first hour and $25 each additional hour unless prior arrangements have been made with JESS.
• I understand that I need to abide by local bicycle laws and if I receive a citation or the scooter is impounded, that is my own responsibility and I will forfeit my scooter rental and will be responsible for any expenses associated with returning the scooter to USAINN along with the full rental cost, even if returned prior to the contracted return date and time.

Protective Headgear Agreement

I, for myself and/or on behalf of my child or legal ward, have been fully warned and advised by Bhagwati Hospitality LLC., D/B/A ” USA INN” , (hereinafter collectively referred to as “USAINN”), that we should purchase and/or wear a properly fitted and secured certified helmet while riding or being around Scooter’s (whether on the premises of USAINN or off the premises), in order to reduce the severity of some of our head injuries and to possibly prevent my/our death from happening as a result of a fall(s) or any other occurrence associated with this activity. We realize that we are subject to injury from this activity and that no form or preplanning can remove all of the danger to which we are exposing ourselves. Against the advice of USAINN, the guide/instructor, numerous court cases and USAINN’s insurance company, we are refusing this critical safety precaution.

SIGNER STATEMENT OF AWARENESS

I/we the undersigned have read the foregoing statement carefully before signing and do understand its warnings and assumption of risks.

CLOSED TOED SHOES AGREEMENT

I, for myself and/or on behalf of my child or legal ward, have been fully warned and advised by Jack’s Electric Scooter Shop, LLC (hereinafter collectively referred to as “USAINN”), that we should purchase and/or wear closed toed shoes while riding or being around a scooter or moped (whether on the premises of USAINN or off the premises) in order to reduce the severity of some toe, foot, knee and other leg injuries and to possibly prevent my/our death from happening as the result of a fall(s) or any other occurrence associated with this activity. We realize that we are subject to injury from this activity and that no form of pre planning can remove all of the danger to which we are exposing ourselves. Against the advice of USAINN, the guide/instructor, numerous court cases and JESS’s insurance company, we are refusing this critical safety precaution.

PROTECTIVE EYE WEAR AGREEMENT

I understand that the use of protective eye wear is required by law to participate in this activity. I agree to adhere to this requirement.

Deposit/Credit and Debit Card Policies: USAINN accepts most major credit cards for credit identification and payment at the time of rental. Debit cards cannot be used as a form of payment of rental charges. Note: Prepaid Debit/Gift cards are not acceptable methods of credit or identification. One of the above mentioned cards must be presented. A deposit of $250 per scooter will be required at time of rental.

No Show Policy or Cancellation: As a courtesy to fellow customers please cancel any unneeded reservations as soon as your plans change. A cancellation fee of 100% will be deducted if reservations are not canceled at least 24 hours prior to the reservation date.

Rental Extension: The scooter is due back at the date/time specified on the rental agreement. If you need to extend your rental, you must call us at least 1 hour prior to the return time to ensure it has not already been rented.

Out of Battery: The scooter is fully charged at the time of rental, customer is responsible to charge the battery as needed. If you forget to charge the battery and become stranded, you may call us and request a delivery of a fully charged battery, at a fee of $35.

Only one (1) person is allowed on the Scooter at a time, weight limit is not to exceed 300 lbs (including cargo). Any damage caused by not adhering to these rules will be the renter’s sole responsibility. Only the authorized driver(s) are to drive the Scooter, no one under the age of 18 is allowed to drive the Scooter at any time. All drivers must sign the Rental Agreement Waiver form.

By signing this document, I acknowledge that if anyone is hurt or property is damaged during my participation in this activity, I may be found by a court of law to have waived my right to maintain a lawsuit against USAINN on the basis of any claim from which I have released them herein. By signing below you agree to the terms and conditions of this Agreement as set forth in this agreement and any other document that you sign; authorize us to process all charges for the rental and authorize us to release your billing/rental information to third parties for billing/processing purposes. All Charges are subject to final audit.

I have had sufficient opportunity to read this entire document. I have read and understood it, and I agree to be bound by its terms.
